The new ETHICS CODE OF PROFESSIONAL CONDUCT FOR HEALTHCARE ETHICS & COMPLIANCE PROFESSIONALS is now a reality (you will find the full Code by clicking here).

The ETHICS Code is the culmination of a year-long effort by the working group which was created after the 2019 General Assembly during which the concept of a code for the members of ETHICS was approved. The working group was headed by Piergiorgio Pepe and included Stephen Nguyen-Duc, who represented the Strategic Committee, Giota Papamarkou, Bella Hovhannisyan, Eveline Loriaux, Edoardo Lazzarini and the ETHICS Executive Director, Clarisse Aillet.

It was presented in draft form to the General Assembly on November 12, 2020 and was formally adopted by the ETHICS Board on December 4, 2020.

During the 2020 General Assembly, Giota Papamarkou, introduced the draft Code to our members and summarized its various sections. The Code is comprised of a Preamble and three main Sections: Duties to the Public Interest, Duties to the Profession and Duties to the Employer.

The Preamble sets forth the basic philosophy behind the Code which is that ethics, integrity and trust must always come first in the work we do. The Code also emphasizes the strategic role that healthcare ethics and compliance professionals must play in their organizations and offers guidance to members when faced with conflicts. Finally, the Preamble states that the rules set out in the Code are not compulsory, but rather “an instrument of professional and personal self-reflection” in order to help members “understand the scale of our duties, recognize our moral commitments and responsibilities, and make the right choices all along the way.”

Section 1 of the Code (Duties to the Public Interest) is comprised of six subsections that deal with the standards that Ethics and Compliance Professionals are expected to meet and emphasizes that non-compliant activities must not be tolerated.

Section 2 of the Code (Duties to the Profession) includes seven subsections which set out the standards of conduct and professionalism that Ethics and Compliance Professionals must respect as well as the requirement of ensuring the fair and equal treatment of everyone inside and outside of their organizations.

Section 3 of the Code (Duties to the Employer) contains fifteen subsections with guidance on how Ethics and Compliance Professionals should conduct themselves within their organizations.

Anne-Sophie Bricca

Anne-Sophie Bricca is Deputy General Counsel at Terumo BCT, a global leader in blood components and cellular technologies, member of the Terumo group. With her team, she provides legal and compliance support to Terumo BCT sales entities in EMEA. She is a member of Terumo BCT Executive Leadership Team. She represents Terumo group at MedTech Europe (the European association of the medical devices and diagnostic industry) and since January 2019, she assumes the Chair of the Ethics and Compliance Group and seats at the Code Committee. S is also member of the Board and Co-Chair of the Strategic Committee of ETHICS (International Society of Healthcare Ethics and Compliance).

Before joining Terumo BCT in 2009, Anne-Sophie Bricca worked as in-house counsel for the IT industry during 10 years (HP, CPG International, Ingram Micro). She also worked as a general counsel for Franco Dragone Entertainment Group for the design and making of the Macao show “The House of Dancing Water”.

Anne-Sophie holds two post graduates degrees in European Laws from the University Robert Schuman (Strasbourg) and in International Laws from the Université Libre de Bruxelles (Brussels). She was the laureate of the international Rousseau Competition in International Laws chaired by Boutros Boutros-Ghali in 1997.

Piergiorgio Pepe

Piergiorgio Pepe is a compliance and ethics advisor, president of Quantum Ethics. He advises companies and institutions on ethics and compliance in healthcare, cosmetics, contemporary art and beyond. Piergiorgio is active in the academic field of compliance and ethics; he regularly teaches courses at Sciences Po, INSEAD, Seton Hall and is active in publishing. From 2013 to 2018, Piergiorgio worked at AbbVie (Compliance Director, Western Europe Canada and Compliance Director, Eastern-Europe, Middle-East and Africa). From 2006 to 2013, Piergiorgio worked as Business Compliance Program Director EMEA, Bristol-Myers Squibb. From 1997 to 2006, he was senior lawyer in the EU department of the international law firm Simmons & Simmons, London.

Piergiorgio is a law graduate and holds masters in EU Law (Institute of European Studies, ULB, Brussels). He is a Solicitor of the Supreme Court (England and Wales) and an Italian Avvocato. He works in English, Italian, French, Spanish. He is a member of the Strategic Committee of the ETHICS Society and has greatly contributed to draft the ETHICS Code of Professional Conduct for Healthcare Compliance Professionals.

Helmut Buss

Helmut Buss has been working for over 30 years in international humanitarian organisations on different continents and in various leadership functions.

Before his appointment as Director of the Ethics Office of the United Nations High Commissioner for Refugees (UNHCR), he worked as Ombudsman for the International Committee of the Red Cross and Red Crescent (ICRC) based in Geneva, following an assignment as Ombudsman for the United Nations Funds and Programmes (UNDP, UNFPA, UNICEF, UNOPS and UN Women), based in New York.

Prior to that and following work as an attorney, Mr. Buss had worked with UNHCR for some 20 years, assuming various functions both at headquarters in Geneva and in the field, including assignments as of UNHCR’s Legal Counsel and UNHCR’s country Representative in Kyrgyzstan.

Mr. Buss holds a Law degree from Hamburg University and an MBA degree from the Open University Business School in the United Kingdom as well as a Master’s degree in Mediation from the Institut Universitaire Kurt Boesch (IUKB) in Sion, Switzerland. He is a national of Germany, is married and has two daughters.

Nadège Rochel

Key member of the compliance team at Hollister Incorporated for more than 6 years. Nadège serves as a Global Compliance Manager. She is responsible for enhancing Hollister's global compliance program to promote compliance with applicable laws and company policies and procedures in Europe; the Middle East, and Africa; and Asia Pacific.

Prior to Hollister, Nadège worked in Compliance at GE Healthcare in France and Finland. Before venturing into the compliance world, she worked as legal counsel in law firms in France and Spain, focusing primarily on international law.

Stephen Nguyen-Duc

Stephen Nguyen-Duc joined Medday Pharmaceuticals in November 2018 as Vice-President Global Head of Ethics & Compliance and Human Resources.

Stephen graduated from the Pharmacy School of Paris with a major in industrial pharmacy and pharmacology. He is also an alumni of the INSEAD Business School complemented by a healthcare Compliance Certificate from Sciences Po Paris and Seton Hall Law School.

As part of his career, he has held several senior positions in Clinical Operations, Human Resources and Compliance in multinational Pharmaceutical companies. In his last position before Medday, he was the Compliance Officer for Europe and Canada at Abbvie Pharmaceuticals.

Stephen is an active member of various pharmaceutical industry associations and committees, proactively addressing Trust, Reputation and Compliance matters. He is Board member and Vice-Chair of the strategic committee of ETHICS, the International Association of Healthcare Ethics and Compliance Officers.

Giota Papamarkou

Giota Papamarkou is a senior healthcare ethics & compliance professional with over thirteen years of experience in international pharmaceutical companies having held roles with country, regional and global oversight.

Passionate about doing the right thing for the patients and the society overall, she had dedicated her career to establish ethics and compliance infrastructure, governance and oversight and to create and establish the Ethics & Compliance Professional’s role within organisations as a business enabler guiding ethical and compliant decision-making and cultivating an ethical culture with focus on individual’s ownership and accountability.

Giota has driven the development and continuous enhancement of anticorruption controls and has conducted and led monitoring activities and investigations across various countries in the world. She is a member of the ETHICS Association, actively working towards creating the Code of Professional Conduct for Healthcare Ethics & Compliance Professionals.

Born and raised in Greece, Giota obtained a university degree in Management Science & Technology from the Athens University of Economics and Business, she later completed the Sciences Po European Healthcare Compliance, Ethics and Regulation Programme, the INSEAD Healthcare Compliance Implementation Leadership Programme - Parts II and III, the London Business School Leadership Programme and recently the Seton Hall Law U.S. Healthcare Compliance Program.

Giota is currently Vice-President Business Ethics at Ipsen, she lives in Paris and speaks Greek, English and French.

Roxana Family

Graduate of both Private and International Private Law, Roxana Family was awarded a doctorate degree (magna cum laude) by the University of Paris 2 Panthéon-Assas. She wrote her PhD on Fiduciary transactions (Study of private law and private international law). She worked as a corporate lawyer and practiced as a lawyer in Paris.

In 2001, Roxana Family joined the School of Law at CY Cergy Paris Univeristé (former University of Cergy-Pontoise) as Senior Lecturer. She participated in the implementation of the European higher educational reform (LMD) prior to being elected as the Vice Dean for international development (2006- 2008). Appointed by the President as official representative for the development of the University (2008-2012), she helped the creation of the Foundation of CY, then contributed to the fund raising campaign and currently serves as a member of the Foundation’s Board of Directors. In May 2008, she was elected as the Dean of the School of Law, a position she held until April 2016. She was then appointed as the Executive Vice President of the University for international development until 2020. Since 2007, she is the Chair of Law and Business Ethics and Director of the Master of Law and Business Ethics, a pioneer program in the field of Corporate Governance, Risk Management and Compliance, that she launched in 2008.

Roxana’s research focuses on business ethics, corporate governance, risk management, compliance and corporate social responsibility. In October 2013, she founded the bilingual (French-English) International Review of Compliance and Business Ethics (IRCBE-RICEA) with LexisNexis publications and acts as the Scientific Director of the Review. She was a member of the National Council of Law from 2015 to 2020. She is currently a member of various boards of ethics or CSR in corporations and think tanks, expert for oversight committees in cross-border investigations, member of the Board of Directors of the Cercle d’éthique des affaires Association since 2014, Compliance advisor for Club Afrique-France Invest since 2016 and member of the Medicis Committee since 2018. In 2017, Roxana received the insignia of Knight in the Order of the Academic Palms.

Craig Smith

Professor N. Craig Smith has been on the INSEAD faculty since 2007 as the INSEAD Chair in Ethics and Social Responsibility at INSEAD in Fontainebleau, France. He was previously on the faculties of London Business School, Georgetown University, and Harvard Business School. Smith directs the INSEAD Healthcare Compliance Implementation Leadership Programmes in Fontainebleau and the Ethics and Compliance Leadership Programme in Singapore.

At INSEAD, Smith teaches and directs programmes on business ethics and corporate social responsibility/sustainability, including Managing Ethics and Compliance. Smith’s research is at the intersection of business and society, encompassing business/marketing ethics, corporate social responsibility, and sustainability strategies. He is the author, coauthor or coeditor of eight books and over forty academic journal articles. His latest books are The Moral Responsibility of Firms (with Orts; published by Oxford University Press, 2017) and Managing the Sustainable Business (with Lenssen; published by Springer, 2018). Smith is also a frequent contributor to INSEAD Knowledge.

Smith has developed over forty case studies, including many award-winners and best-sellers. A number of Smith’s journal articles and case studies focus on the healthcare industry, including topics such as pharmaceutical marketing practices and access to essential medicines.
As well as a regular speaker at international conferences, he conducts workshops and consultancy assignments with various organizations on business ethics, compliance and corporate responsibility/sustainability.

Martin Krauss

Martin Krauss has over 25 years of experience in the area of clinical and epidemiological studies, including work in biometry, statistical consulting, SAS programming, clinical research management, phase II-IV trials, post marketing surveillance, quality assurance, structuring and optimization of processes, project management in national and international studies, medical device investigations, speaker in seminars in biometry, GCP-related fields and medical devices, auditing.

He has been Managing Director for more than 20 years, which includes responsibilities for human resources, controlling, accounting, clinical operations and business development. Since many years, Martin is a statistical consultant in drug development including preparation and attending numerous meetings with authorities in Europe (e.g., EMA, MHRA, MEB, MPA, BfArM etc.) and USA (FDA). In November 2017, he was elected as new President of the German CRO association BVMA.

Sara Ortoli

Sara is an associate in the Antitrust department of Clifford Chance, in Paris. She specializes in EU and French competition law. She has experience advising on merger control investigations as well as antitrust proceedings, before the European Commission, the French Competition Authority as well as EU and national courts. She has acquired particular expertise in the pharmaceutical sector.

Before joining Clifford Chance in 2017, Sara was an associate in the Antitrust department of Willkie Farr & Gallagher for 2 years. Prior to that, she was a trainee at DG Competition at the European Commission. Sara graduated from HEC Paris Business School, and obtained both an LL.M in EU and Competition Law from Kings College, London, and a Master 2 Degree in Business & Tax law from Université Paris I – Panthéon Sorbonne.

Tribute to Dave O’Shaughnessy

Our Association has lost one of its most talented members.

Our friend Dave O'Shaughnessy passed away on October 5.

Dave stood at the cradle of ETHICS around ten years ago and, as a Member of the Board of Directors and of the Strategic Committee, has always been instrumental in suggesting new priorities and initiatives for our Association and implementing the different action plans which were agreed, with a permanent effort to share knowledge and contribute to the development of younger professionals.

Dave’s early career with Glaxo (which became GlaxoSmithKline) included working in clinical trials and quality, which led to him living and working in Singapore. He moved from Singapore to UK to take up the role of International Compliance Officer for GlaxoSmithKline in 2004. Dave then moved to AstraZeneca in 2010 as VP Global Compliance Strategy & Implementation before moving to the Contract Research Organisation Quintiles (which became IQVIA) as VP Compliance, R&D Solutions.

In 2018, he joined Johnson & Johnson where he was a key member of the Healthcare Compliance for Janssen Research and Development in EMEA.

Dave was an example to our profession and many of us have learnt a lot from him.  In all his roles, he brought a “human touch”, both during working hours and after the work was done. Dave truly was a “larger than life character” with the ability to bring together disparate people with different ideas to come to an agreed conclusion in any situation. He was a wonderful person, and we will miss him.

Our thoughts and deepest sympathies are with Dave's wife and their two sons.
